Tiernan acknowledges receipt of the duplicate of the lost check and reports receiving a letter from the cashier of the Philadelphia Bank stating that the original check had been used. She never received the original. Since payment on the draft was promptly stopped, it is the bank and not Tiernan that should lose the money.
