Scope and Contents
In the case on which Lavialle requested Purcell's opinion, he did not raise the question of the existence of the solicitation but his question was whether it be a case of the "crime" of solicitation with the penalty of suspension, and whether the priest himself was bound to report the sin to the proper authority and whether the confessor should inflict the penalty. Lavialle finds that in 1857 Archbishop Francis Patrick Kenrick of Baltimore obtained from the Holy See as a special authorization to have the 40 Hours with the Blessed Sacrament exposed only during the day. Lavialle judged there existed at that time no general authorization for the modification stated and desired to know whether such privilege had been granted in general.
