Scope and Contents
At Berthet's request he gives him a statement of the suit of St. Mary of Mt. Carmel vs. Executors of Estate of Mrs. Reilly . Reilly died in 1877, testate, appointing B. Farrelly and William Homrich executors and having made the Church her universal legatee. The executors caused the real estate and most of the personal property to be sold. The Probate Court, on the application of a creditor, ordered the executors to file an account of their administration. Failing to comply, an order was served to show cause why they should not be punished for contempt. They answered by paying the creditor some $250 and her proceeding stopped. Leake was employed by Berthet to force a settlement. He filed suit to destitute the executors and force them to pay the penalties, 10% for not filing an accounting within one year and 20% for not depositing the money and keeping a bank book as required by law. They filed exceptions, which being overruled, they filed an accounting in which they charge several hundred dollars against the estate.
